An article published Aug. 27 incorrectly stated that Capital City Tree Service responded to the March 2023 Wynne tornado. The sources used for the article did not support that statement, and Capital City Tree Service says it did not perform work in Wynne.
The article also did not clearly distinguish between the jury’s verdict and the court’s subsequent penalty determination. The jury found the company liable on one claim involving unconscionable business practices but did not identify the specific acts or determine the number of violations. Following the trial, the court entered a $470,000 judgment based on 47 violations and the maximum statutory penalty of $10,000 per violation.
The jury ruled in favor of Charles and Matthew Shaw individually, and the court directed a verdict in favor of Janet Shaw.
The Wynne Progress regrets the errors.
